ELECTRICAL SERVICES AGREEMENT This Electrical Services Agreement (the “Agreement”) is made and entered into by and between Home Love Electrical, LLC DBA Home Love Electric (the “Electrician”) and the client who has signed and accepted the proposal for electrical services (the “Client”). This Agreement sets forth the terms and conditions under which the Electrician agrees to provide electrical services to the Client. 1. SCOPE OF WORK The Electrician agrees to dutifully and faithfully complete the installation, repair, or replacement of electrical fixtures and wiring as described in the approved quote. The Electrician does not guarantee a completion timeline but agrees to complete all work in accordance with applicable industry standards, Florida state building codes, and in a workmanlike manner. The Electrician will perform the work as expeditiously as permitted by the Electrician’s own schedule. ADDITIONAL CLIENT ACKNOWLEDGMENTS The Client acknowledges that electrical work may involve inherent risks, including but not limited to potential disruptions to electrical power service, noise, and dust. The Client agrees to make reasonable accommodations to allow the Electrician to complete the work effectively and safely. 2. DEPOSITS AND PAYMENTS Any deposits paid for electrical services are non-refundable. The Client acknowledges and agrees that all amounts paid toward electrical services are final and shall not be subject to refund, except as required by law. The Client understands that deposits serve as a commitment to secure labor and materials necessary for the project. Failure to proceed with the scheduled work does not entitle the Client to a refund of any payments made. All outstanding balances must be paid promptly upon project completion. Late payments may be subject to additional fees, interest charges, or legal action to recover the amount due. The Client agrees to make all payments in accordance with the payment schedule outlined in the quote or contract agreement. 3. REPAIRS TO FINISHES & ACCESS PANELS The Client acknowledges that in the course of performing electrical work, it may be necessary for the Electrician to cut or remove sections of flooring, drywall, or other finishes to access electrical wires and cables. The Electrician shall not be responsible for repairing or replacing any such finishes. The costs associated with repairing, replacing, or restoring any affected finishes shall be the sole responsibility of the Client. Furthermore, access panels shall only be installed in locations where they are explicitly included in the Electrician’s written quote. If an access panel is not listed in the quote, it is not included in the scope of work. 4. LIMITATION OF LIABILITY FOR EXISTING FINISHES The Electrician shall not be responsible for damages to existing finishes caused by normal wear and tear in the course of work, including but not limited to paint chipping, flooring wear, discoloration, or other cosmetic damages. The Client acknowledges that such damages are an inherent risk in electrical work and assumes full responsibility for any restoration or repair costs. 5. NO GUARANTEE OF COMPLETION TIMELINE The Client expressly waives any claims related to project completion timelines, and the Electrician shall not be liable for any delays. The Electrician does not guarantee specific start or completion dates and disclaims any and all liability for work timeline requirements, including but not limited to those set forth under Florida Statutes § 489.126. The client agrees that the permitting and work start timelines as set out in Florida Statutes § 489.126 are waived in regards to this and all future work which the Electrician and the Client may agree to complete. 6. LIMITED WORKMANSHIP WARRANTY The Electrician warrants that all work performed shall be free from defects in workmanship for a period of one (1) year from the date of completion. This warranty does not cover any failures or defects in materials or equipment supplied by the Client, nor does it cover damages resulting from misuse, abuse, neglect, or normal wear and tear. To make a warranty claim, the Client must submit a written notice of deficiency to info@homeloveelectric.com or via mail to 51 S Main Ave Suite 240, Clearwater, FL. Failure to provide written notice shall void any warranty claims. The Client further acknowledges that any modifications, repairs, or alterations made to the Electrician’s work by any party other than the Electrician shall void all warranties. 7. DISPUTE RESOLUTION – MEDIATION & ARBITRATION The parties agree to waive the right to a jury trial in connection with any dispute, claim, or legal action arising out of or relating to this services agreement, or the interpretation or enforcement of this agreement. In the event of any dispute, claim, or controversy arising out of or relating to this Agreement, the parties agree to first attempt to resolve the matter through mandatory mediation. If mediation is unsuccessful, the dispute shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in accordance with the rules of the American Arbitration Association (AAA) and the Federal Arbitration Act. The decision and award of the arbitrator shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction. 8. NO WAIVER OF RIGHTS No waiver of any provision of this Agreement shall be deemed to have been made unless expressed in writing and signed by an authorized representative of the waiving party. Failure or delay in exercising any right, power, or privilege shall not operate as a waiver of such right, nor shall any partial exercise preclude further enforcement. 9. GOVERNING LAW This Agreement shall be governed by, and construed in accordance with, the laws of the State of Florida, without regard to conflicts of law principles. Any disputes arising under this Agreement shall be resolved exclusively within the courts of the State of Florida, subject to the arbitration provisions above. 10. ACCESS TO JOB SITE The Client agrees to provide the Electrician with unrestricted access to the job site between the hours of 8:00 AM and 6:00 PM. In the event that emergency services are required or requested, the Client shall ensure that access is granted to the home or job site at any time the Electrician arrives to perform the necessary work. 11. THIRD-PARTY FINANCING DISCLAIMER The Client acknowledges and agrees that the Electrician does not provide, offer, or guarantee financing in any capacity. Any financing options available to the Client are provided exclusively by third-party lenders who are not agents, affiliates, or representatives of the Electrician. The Electrician disclaims any and all liability for financing applications, approvals, denials, interest rates, terms, or any other financing-related matters. The Client holds the Electrician harmless from any claims, damages, losses, liabilities, or disputes arising from or related to third-party financing, including but not limited to credit denials, changes in financing terms, late fees, penalties, or contractual obligations with the lender. The Client assumes full responsibility for understanding and agreeing to the terms and conditions of any third-party financing arrangement. 12. ACCEPTANCE OF TERMS By signing this proposal, the Client acknowledges that they have read, understand, and agree to the terms and conditions outlined in this Agreement. The Client further agrees and acknowledges that they are contracting with a licensed electrical contractor. The Electrician’s license is as displayed in the Electrician’s advertising, and the Client has had the opportunity to verify the license status before engaging in services.
